Court Orders Swiggy To Compensate Customer For Failing To Delivery Ice Cream: Report

A Consumer Court in Bengaluru recently directed food-tech platform Swiggy to compensate a customer for not delivering an ice cream, he ordered in 2023. As per reports, the food delivery app is ordered to pay Rs. 3,000 as compensation, apart from Rs. 2,000 as litigation costs. The Bangalore Urban II Additional District Consumer Redressal Commission also directed the platform to refund Rs. 187, the amount of the ice cream that the customer paid while placing the order.

As per sources, the complainant ordered an ice cream called 'Nutty Death By Chocolate' through Swiggy on 26th January 2023 at around 1.54 pm. The order was from the restaurant 'Cream Stone Ice Cream' in Bengaluru and was priced at Rs. 187. Reportedly, the order was picked up by a Swiggy agent after 35 minutes and was never delivered to the complainant. However, the status of the order was shown as 'delivered' on the app. In this regard, the person also sent out an e-mail to the food-tech giant and requested a refund of the amount he paid, which the latter failed to do. This prompted the complainant to approach the consumer forum for relief and compensation of Rs. 10,000 and Rs. 7,500 as litigation costs.

Swiggy, on the other hand, contested that it was a situation between the third-party restaurant and the delivery agent, and the company was not in a position to check if the order was delivered, especially when it was marked as delivered on the app. Hence, they maintained that Swiggy could not be held liable for the alleged mistake.

The reports further explain that while analyzing the case, the bench of the jury found that Swiggy failed to respond to the legal notice issued by the customer for a refund. The consumer forum ruling read that the complainant could prove the "deficiency of service" from Swiggy's side, which is also looked upon as an act of "unfair trade practice".

However, the bench stated that the compensation of Rs. 10,000 and Rs. 7,500 as litigation costs appeared to be exorbitant. Hence, they ordered the opposite party (here: Swiggy) to refund Rs. 187, and pay Rs. 3,000 and Rs. 2000 as compensation and litigation costs respectively.

A few weeks back, I found myself at a charming plant-based cafe tucked away in the heart of Bengaluru by the name "JustBe Cafe", and I stumbled upon a delightful surprise, the "Vegan Deconstructed Strawberry Sandesh". Staying sweet amidst the other plant-based delicacies, the vegan twist on the Sandesh caught my attention and piqued my curiosity. As I took my first bite, I realized that there was something uniquely satisfying about this guilt-free indulgence. With my curiosity tingling, I was eager to meet the curator and understand how this Bengali classic got the perfect blend of tradition and innovation, all wrapped up in a creamy, decadent dessert.

I had a chat with Nidhi Sogani Nahata, the founder of Just Be Cafe, the curator of this dessert, who is also a certified lifestyle and health coach and a vegan recipe curator. Nidhi said, "I've had a lifelong love affair with Sandesh, especially the Nolen Gur Sandesh. But ever since I embraced the vegan lifestyle, I found myself longing for its flavours. I also found the same void amidst many sweet lovers who turned vegan for better health and there began my quest to reimagine and create a perfect vegan Sandesh, thereby making it a guilt-free indulgence that will suit people with different dietary preferences".

She swapped cow milk with coconut milk and almond milk, Chena with Tofu, refined sugar with Nolen Gur, and splashed a good measure of strawberries, pistachios and coconut flakes, enhancing the overall nutritional profile of the dessert and as satisfying as its dairy-laden counterpart.

Recipe Courtesy: Nidhi Nahata, Founder of JustBe Cafe

Ingredients:

  • Silken Tofu - 2 cups.
  • Coconut Milk - One and a half cups,
  • Plant-based milk of your choice (Almond, soy, oats milk) - 1/2 cup.
  • Nolen Gur - 1/2 cup.
  • Cardamom Powder - 1 tsp
  • Pinch of Saffron
  • Pinch of Salt
  • Pistachio - 2 tbsp chopped
  • Strawberries - 4-6 finely chopped (You can also use any seasonal fruit of your choice)
  • Unsweetened coconut flakes and mint leaves for garnish.

For The Strawberry Compote:

  • Strawberries - 1 cup.
  • Nolen Gur - 2 tbsp.

Strawberry Compote Recipe:

In a pan, prepare the strawberry compote by simmering diced strawberries with Nolen Gur until it thickens. Keep it aside and let it cool.

Sandesh Recipe:

  • In a heavy-bottomed pan, combine silken tofu and coconut milk over low-medium heat. Simmer until the mixture thickens (approximately 7-10 minutes).
  • Add plant-based milk, Nolen Gur, cardamom powder, saffron, pistachio and a pinch of salt. Mix gently and simmer for 5 minutes until the mixture comes together.
  • Transfer this mixture to a bowl and let it cool for 8-10 minutes. Ensure that the mixture is not too dry.
  • Take a 3-inch cake pan/mould, add half the Sandesh mixture, and flatten it gently with a spatula. Layer with strawberry compote and top it up with the remaining Sandesh mixture.
  • Now cover it up and chill in the fridge for an hour.
  • Remove the cake pan/mould from the fridge and now decorate it with sliced strawberries, coconut flakes, pistachios, mint leaves and some edible flowers.
  • Before serving, you can also glaze it with maple syrup and serve it with a heart full of love.

How To Know If You Are Really Hungry Or Not? Expert Explains How To Listen To Your Body

We know that the previous meal digestion is completely done, when the churn of the food that it goes through has happened, the absorption of the food which is assimilating the nutrients out of it has happened and then efficiently the elimination process is complete. There is then a rest period with the organs. Once the stomach bag is completely cleared of it all and the channels are cleared too, gradually hunger peaks. And when hunger peaks, you know that's hunger and not lust for food. Drooling happens. The acid pours into your stomach, prepared and ready to receive food.

Understanding whether you're truly hungry or not involves a delicate balance of physical cues, emotional states, and habitual behaviours.

Hunger is the need of the body and appetite is the lust of the mind. Registering the needs of the body by the mind is when the body wants fuel. The fuel is for sustenance - longevity, immunity and vitality. For this sustenance fuel, we need food. Food can only be consumed when we are hungry when hunger peaks.

  • Pangs of lust for food is eating out of habit, boredom, stress, or thirst. But hungry eating is eating out of an instinctive biological need to provide food as fuel to the body. Hunger pangs are more instinctive than pangs for lust for food.
  • Genuine hunger can lead to feelings of weakness, low energy levels, or fatigue as your body's energy reserves become depleted.
  • Also, true hunger typically manifests as a gnawing sensation or emptiness in the stomach, often accompanied by growling or rumbling sounds. It is the body's way of signalling a need for nourishment and energy replenishment.
  • The more the body can organically recognize and receive happy food, the food that is kind to your body, food that is closest to nature, sattvic food, clean food, such foods get digested in less than under 4 hours completely.
  • These foods are humming foods. They are full of vitality and energy. The body will easily digest such food and the hunger after such foods will peak stronger. 
  • One must also consider the timing of the last meal or snack. If you have recently eaten a balanced meal, it is less likely that you will be truly hungry again soon.
  • Sometimes, simply being thirsty could also lead you to eat thinking you are hungry when what your body really needs is hydration. Before reaching for a snack, try drinking a glass of water and wait a few minutes to see if the sensation subsides.

Tune into your body's signals, listen to them carefully and practice conscious eating. Conscious eating means paying attention to the sensory experience of eating, including the taste, texture, and smell of food, as well as recognizing hunger and fullness cues.
